Terms of Use

Last Updated: Sep 20, 2026

These Terms of Use (the “Terms” or “Agreement”) govern your access to BodySway and the services offered through it. They apply to the BodySway mobile application (the “Mobile App”), our website (the “Site”), and the related software, features, content, communications, and services described in this Agreement (together, the “Services”). MASICORP UK LTD., together with its affiliates and subsidiaries (the “Company,” “we,” or “us”), owns and operates the Site and Mobile App.

PLEASE REVIEW THIS AGREEMENT BEFORE USING BODYSWAY. IT EXPLAINS YOUR RESPONSIBILITIES, YOUR LEGAL RIGHTS, AND THE REMEDIES AND LIMITATIONS THAT APPLY TO THE SERVICES.

This Agreement is legally binding between the Company and the person using the Services (“you” or “your”). It has the same effect as an agreement recorded on paper and becomes effective when you accept it, including through conduct treated as acceptance under these Terms.

IMPORTANT: PAY PARTICULAR ATTENTION TO THE HEALTH DISCLAIMERS, CONTENT LICENSES, ASSUMPTION OF RISKS, RELEASE, AND TERMINATION PROVISIONS BELOW, AS THEY AFFECT YOUR RIGHTS AND RESPONSIBILITIES.

We may revise these Terms at any time and for any reason. Please review them periodically so that you understand the conditions currently in force. If you continue using or accessing the Services once a revision takes effect, you agree to the revised Terms. If you do not accept this Agreement, you must stop using the Services immediately.

Platform Services

BodySway brings together (i) information you authorize from Apple Health accounts and other external health-data providers (“Third-Party Sources”) and (ii) health scores and general reference information generated using that data. These functions help you view health-related records and reference information through the Services. You agree that we may update, modify, or otherwise change the Services at our discretion. The terms of each Third-Party Source govern that provider’s own availability and functionality.

Acknowledgement and Disclaimers

Your use of BodySway is subject to the following acknowledgements:

  1. BodySway supplies general information about health, fitness, and wellbeing. It is not a source of medical advice, diagnosis, or treatment, and must not be used as a replacement for those services. Material provided through BodySway does not amount to medical practice, mental-health care, physical therapy, professional care, or counseling. The information on our platform is not provided by licensed medical doctors. We do not diagnose or treat illness, injury, or disease, and we do not prescribe medication.
  2. No part of the Services replaces advice from a physician or another healthcare professional, or a visit, telephone call, or consultation with one. This applies to all material we or Third-Party Sources supply, including written information, photographs, illustrations, graphics, audio, video, combined audiovisual material, and other content.
  3. Consult an appropriate healthcare provider promptly about health concerns. Do not ignore professional advice or postpone seeking it because of anything you read or receive through BodySway. The Services must not be used to diagnose or treat a health problem. Receiving information from us or communicating with us online, by email, or through another channel does not establish a doctor-patient, therapist-patient, or other professional healthcare relationship.
  4. Speak to a physician before using information from the Services to change your sleep or activity habits, or whenever you have questions about a medical condition. Changes you choose to make based on the Services are undertaken at your own risk, and we are not responsible for resulting health problems. Pay attention to how your body responds. Unexpected, recurring, or persistent pain, fatigue, or discomfort following a change is a reason to consult a physician before continuing. Information based on population patterns may be unsuitable or misleading for people whose physiological responses differ substantially because of a medical condition or an uncommon natural variation.
  5. IN A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER WITHOUT DELAY. IN THE UNITED STATES, CALL 911.
  6. Automated and Generated Content Disclaimer. Some functions may use automated methods or algorithms to produce insights, explanations, summaries, suggestions, or interactive responses from your entries and Third-Party Source data (“Automated Outputs”). These outputs serve general health, fitness, and wellbeing information purposes. They neither provide medical advice, diagnosis, or treatment nor replace a qualified healthcare professional. Outputs can be incorrect, incomplete, out of date, or unsuitable for your circumstances, and may omit factors relevant to your health. You are responsible for assessing their suitability and deciding whether to act on them. We make no assurance that Automated Outputs are accurate, complete, or reliable. We may change, suspend, or withdraw automated functions at any time without notice.

General

Within the framework of this Agreement, you are responsible for how you use the Services, the material you submit or access, and the consequences of those activities. References to “Content” include information, reports, data and databases, graphics, interfaces, web pages, written material, files, software, product and company names, trademarks, logos, trade names, and other content made available through the Services.

Privacy

Our Privacy Policy, available at https://www.masicorpltd.com/wellbeat/privacy/ (the “Privacy Policy”), forms part of this Agreement by reference. Accessing or using the Services signifies your express agreement to both documents. If you do not accept them, you may not use the Services. The Privacy Policy explains how we collect and use information you provide. By using the Services, you consent to the collection and use described in that policy.

Content

The Services may allow you or your authorized users (“Authorized Users”) to submit feedback, written material, photographs, information, or other Content. A submission, regardless of its format or delivery method, grants the Company permission to copy, modify, distribute, create derivative works from, and otherwise exploit that Content without limitation. This license is non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable. Personal information included in Content is handled as explained in the Privacy Policy. You are solely responsible for submissions made by you or your Authorized Users, and you warrant that you own the necessary rights or have authority to grant this license. You are liable for submissions that infringe another party’s intellectual property or privacy rights. You further represent and warrant that submitted Content meets each of these requirements:

  • It is not produced solely for advertising or commercial promotion, including promotional use of company names, logos, or links;
  • It does not consist of spam, unsolicited contact, or repeated postings that disrupt the Services;
  • It does not encourage unlawful or harmful conduct or include sexually explicit, violent, graphic, threatening, or harassing material;
  • It does not falsely present its source as another person, account, or organization, including a Company representative;
  • It is lawful and respects the rights of other people and organizations, including their intellectual property and privacy; and
  • It does not disclose another person’s confidential or private details, including information sufficient to identify the location of a listing.

Do not submit material protected by copyright, trade secret, privacy, publicity, or other proprietary rights unless you hold those rights or have the rights holder’s permission both to submit the material and to grant the permissions set out here. If you breach this section, you agree to defend the Company against resulting claims and to indemnify and hold it harmless for resulting loss, damage, or liability.

Content

Your activities through the Services must have a lawful purpose and comply with the laws and regulations of every jurisdiction in which you access or use them. Fraudulent conduct, unlawful activity, and abusive use of the Services are prohibited.

Restrictions On Use

You must not engage in any of the following activities:

  1. Distribute the Services for any purpose, including assembling an internal database or reproducing or redistributing them through news media, commercial networks, or cable or satellite systems;
  2. Reproduce, alter, adapt, translate, arrange, or create derivative works from the Services; reverse engineer, decompile, or disassemble them; or copy, bundle, merge, transmit, export, sell, sublicense, transfer, lend, rent, lease, assign, share, outsource, host, publish, or otherwise make all or any part of them available to another person, directly or indirectly, in physical, electronic, or any other form;
  3. Take or permit action that infringes or impairs the proprietary rights of the Company or its licensors, or allow a third party to access the Services;
  4. Conduct vulnerability probing, scanning, or testing against the Services or any associated system or network;
  5. Defeat, bypass, or otherwise interfere with security controls or authentication requirements;
  6. Enter, interfere with, or use private areas of the Services, including shared areas to which you have not been invited;
  7. Use an interface other than one we publicly support to access or search the Services or create accounts;
  8. Advertise or promote another party’s products or services without the necessary authorization;
  9. Improperly evade limits on storage, usage, or transactions, including attempts to avoid our fees;
  10. Post or distribute unlawful or indecent material, or material depicting extreme violence or terrorist activity;
  11. Encourage hatred or bigotry toward a person or group because of race, religion, ethnicity, sex, gender identity, sexual orientation, disability, or impairment;
  12. Harass or abuse Company personnel, representatives, or agents carrying out work on our behalf;
  13. Use any function of the Services to monitor, track, harass, or conduct surveillance of someone who has not knowingly and freely consented;
  14. Store, publish, or distribute fraudulent, defamatory, or misleading material; or
  15. Otherwise use the Services in a way that violates the law.

License Grant to Your Content

For Content and other information you supply through the Services or send to the Company by email or other correspondence, you grant us a license to use, display, reproduce, and store it. Non-public personal information is excluded from this grant. The license is unlimited, worldwide, non-exclusive, transferable, perpetual, irrevocable, and royalty-free; no payment or other compensation is owed for it. Unless the law requires confidentiality or we expressly agree to it in writing, the Company has no confidentiality obligation for material covered by this license. You warrant that you have authority to give these permissions. Health Information and any health-related status data remain subject to the Privacy Policy. This section does not permit their use beyond what is necessary to deliver the relevant functions of the Services.

Suspension of Transactions and Services

We may cancel or suspend a transaction or the Services where fraud or compliance concerns arise. This right is in addition to the termination rights in this Agreement and any other right described in these Terms to alter, suspend, or discontinue the Services.

Third-Party Links and Services

Links in the Services may take you to websites operated by others. You choose to access those websites at your own risk. We do not take responsibility for the accuracy or suitability of their information, data, opinions, advice, or statements. Providing a link does not make us the publisher or distributor of the destination site’s material, and we do not undertake to monitor or control that site. A link or reference to another organization, its products, or its services does not imply affiliation, association, recommendation, or endorsement, including endorsement of that site’s content or further links. We are not responsible for damage suffered by you or another party arising from the sending, storage, or receipt of confidential or proprietary information by you, or by us with your express or implied authorization, or from errors or alterations affecting such information during transmission, storage, or receipt.

Assumption of Risks; Release

  1. You knowingly and voluntarily accept the risks connected with access to and use of the Services, including physical, psychological, and emotional risks, whether or not either party could foresee them. You accept personal responsibility for associated injury, harm, illness, property damage, loss, claims, liability, or expenses of any kind affecting you or your property.
  2. Neither information nor transactions handled through the Services or the internet can be guaranteed to remain confidential and secure. You use the Services at your own risk. To the fullest extent allowed by applicable law, we accept no liability relating to the Services, your use of them, or the receipt, retention, transmission, or other handling of your personal information.
  3. By accessing or using the Services, you agree to release the Company from claims and liability connected with that access or use, and to indemnify and hold it harmless against them, including associated legal fees and costs. This applies to claims arising at any time and to personal, financial, emotional, psychological, or other injury or damage.
  4. California Residents. If you live in California, you expressly waive the protection of California Civil Code Section 1542 to the maximum extent permitted by law. That provision protects claims that a releasing party does not know or suspect exist in their favor when giving a general release, where knowledge of those claims would have materially affected the settlement. California consumers may direct inquiries to the Department of Consumer Affairs’ Consumer Information Center at (800) 952-5210 or dca@dca.ca.gov. Written inquiries may be sent to: Department of Consumer Affairs, Consumer Information Division, 1625 North Market Boulevard, Suite N 112, Sacramento, CA 95834.

Term and Termination

  1. We may, at our sole discretion, change or discontinue any portion of the Services at any time, temporarily or permanently, without advance notice or liability to you.
  2. We may also, at our sole discretion and without advance notice or liability, deactivate or cancel your account, or restrict, suspend, or end your access to some or all of the Services. These measures may be temporary or permanent and may be taken for any reason or no reason. We are not required to explain a suspension or termination to you or to others.
  3. If this Agreement ends, all Services are discontinued, or your right to access all Services ends: (i) amounts and fees you owe the Company become immediately payable; (ii) we may delete your user data without liability, while retaining the right to keep user data for seven (7) years after termination; and (iii) we may cancel orders, trades, or transactions still pending at that time. Aggregated, anonymized data may be retained for longer to improve the Services, combat fraud, and compile statistics. Where a status-sharing function is available, its status data is subject to the Privacy Policy and the specific rule requiring automatic deletion from our servers within twenty-four (24) hours after upload; the general retention period above does not override that rule.
  4. Provisions intended by their nature or wording to continue after termination remain effective. These include indemnities, liability limitations, disclaimers, your warranties, and any other obligations that should reasonably survive the end of the Services or this Agreement.
